1. Assumption of Risk
Snorkelling, swimming, free diving, boat travel, island and sandbank visits, dolphin searching, shark and manta ray excursions, fishing, and other marine activities involve inherent risks including drowning, currents, waves, tides, falls, collisions, injury from coral, rocks, boats or equipment, marine life, sun exposure, dehydration, heat exhaustion, seasickness, allergic reactions, and medical emergencies. I voluntarily accept all known and unknown risks.
2. Medical Declaration
I confirm I am physically and medically fit to participate. I will disclose before departure any heart condition, asthma, epilepsy, pregnancy, recent surgery, serious injury, or other condition that may affect safety. Participation may be refused if considered unsafe.
3. Swimming Ability
Life jackets are available. If I am not a confident swimmer, I will tell the guide before entering the water and follow all instructions.
4. Safety Instructions
I will follow the captain and guides, wear required safety equipment, stay with the group, avoid restricted areas, and enter the water only when instructed. Failure to comply may result in removal without refund. The captain's safety decision is final.
5. Marine Wildlife
Marine animals are wild and unpredictable. I will not touch, chase, feed, or harass them or stand on coral. Wildlife sightings are never guaranteed and do not qualify for a refund.
6. Weather & Operational Changes
Trips, routes, destinations, or schedules may be delayed, modified, shortened, or cancelled for weather, sea conditions, mechanical issues, government restrictions, or safety. The captain's decision is final.
7. Equipment
I will use equipment responsibly, report defects immediately, and return it after use. I may be responsible for loss or intentional damage caused by misuse.
8. Personal Belongings
Maldives Underwater Life is not responsible for loss, theft, or damage to personal belongings including phones, cameras, drones, jewellery, cash, passports, watches, or bags.
9. Photography & Video Consent
Unless I notify the crew before departure, I permit photographs and video from the trip to be used for social media, the website, advertising, and promotion without further permission or compensation.
10. Cancellation & Refund Policy
I have read and accepted the cancellation policy. Wildlife is not guaranteed. Seasickness, choosing not to snorkel, leaving early, or other personal reasons do not qualify for a refund. No refund is provided after the trip starts unless required by law.
11. Last-Minute Booking Policy
Bookings within 24 hours of departure, including same-day and one-hour bookings, are final and non-refundable. Cancellation, no-show, missed departure, or choosing not to participate receives no refund. A transfer may be approved before departure. If the operator cancels for unsafe weather, sea, mechanical, or safety-related reasons, a full refund or rescheduling will be offered.
12. Release of Liability
To the fullest extent permitted by law, I release Maldives Underwater Life, its owners, directors, employees, captains, guides, crew, contractors, and affiliates from claims, liabilities, damages, losses, or expenses arising from participation, except where directly caused by proven gross negligence or wilful misconduct.
13. Minors
Participants under 18 must have this waiver signed by a parent or legal guardian, who accepts responsibility on their behalf.
I confirm that I have read and fully understood this waiver and the risks, voluntarily choose to participate, accept all terms, and understand that this document is legally binding to the fullest extent permitted by law.
